General conditions of CHIVADO PROJECTS (trading under the name MY PLANET LED) Company number BE0821 787 463 located at Kleine Stadenstraat  101 8830 Hooglede.

1. General

1.1 These general conditions apply to all offers of MY PLANET LED. The conditions are accessible to everyone and included on the webshop MY PLANET LED. On request we will send you a written copy.

1.2 By placing an order you acknowledge that you agree to the general conditions and delivery conditions. MY PLANET LED reserves the right to modify  its terms and / or conditions after the expiry of the term. . The ordered goods must be integrally paid into the account of MY PLANET LED beforehand.

1.3 Unless otherwise agreed, the general or specific terms or conditions of third parties are not recognized by MY PLANET LED.

1.4 MY PLANET LED guarantees that the product meets the contract and meets the specifications listed in the offer.

2. Delivery

2.1 Delivery takes place while stock last.

2.2 Under the rules of distance selling, MY PLANET LED will fulfill orders within 30 days. If this is not possible (because the order is out of stock or no longer available), or if there is another reason for delay, or an order cannot or only partially be fulfilled, the consumer receives a message within 1 month after placing the and in that case he is entitled to cancel the order without penalty.

2.3 The supply obligation of MY PLANET LED, will, in the abscence of proof to the contrary, be satisfied once the delivered goods are offered to the customer by MY PLANET LED. For home delivery extends the report of the carrier, alleging refusal of acceptance, full proof of the offer to deliver.

2.4 All periods of time on the website are indicative. Therefore, there can be no rights be derived from the listed terms.

3. Prices

3.1 Prices will not be increased within the duration of the offer, unless legal action is necessary or if the manufacturer increases  prices in the intervening period.

3.2 All prices on the site are subject to misprints. For the consequences of misprints no liability is accepted.

3.3 All prices on the site are in Euros and include 21% VAT.

4. Viewing period / right of withdrawal / complaints

4.1 If there is a consumer purchase, under the distance selling law (Article 7: 5 Civil code), the buyer has the right to return (a part of) the delivered goods. He has 14 days after reception to notify the web shop. Following this notification, the customer has 14 days to return the product effectively. This period begins when the ordered goods are delivered. If after this period, the customer has not notified, the purchase is a fact. The customer must prove that the goods are returned on time, for example through a proof of mail delivery. Return of Goods must be in original packaging (including accessories and documentation) and in new condition. If the goods are used in, encumbered or damaged in any way, the right to dissolve shall lapse within the meaning of this paragraph. With regard to what is stipulated in the preceding sentence, MY PLANET LED ensures it is refunded within 14 days after reception of the return, the full purchase price including the shipping costs to the customer. The return of the goods delivered is the sole responsibility and risk of the buyer.

4.2 complaints

4.2.1 The entrepreneur has a well-publicized complaints and deals with complaints under this procedure.

4.2.2 Complaints about the implementation of the agreement must be made fully and clearly described within seven days to the entrepreneur, after the consumer has found the defects.

4.2.3 The entrepreneur complaints within a period of 14 days from the date of receipt. If a complaint is a foreseeable longer processing time,the entrepreneur answers within a period of  14 days, confirming receipt and indicating when the consumer can expect a more detailed answer.

4.2.4 If the complaint can not be resolved by mutual agreement, it creates a dispute that is subject to dispute settlement.

4.2.5 In case of complaints, primarily a consumer needs to turn to the entrepreneur. For complaints that can not be solved by mutual agreement, the consumer should apply to the Foundation Webwinkelkeur (www.webwinkelkeur.nl), it will mediate free.  Should it not yet come to a solution, the consumer has the opportunity to treat his complaint by “Stichting Dispute Online” (www.geschilonline.com), the decision thereof is binding and both entrepreneurs and consumers agree with this binding judgment. For the submission of a dispute to the arbitration committee are costs that must be paid by the consumer to the relevant committee. It is also possible to notify complaints through the European ODR platform (http://ec.europa.eu/odr).

4.2.6 A complaint does not suspend the obligations of the entrepreneur, unless the entrepreneur specifies otherwise.

4.2.7 If a complaint is accepted by the entrepreneur, the entrepreneur will, at its option repair or replace the delivered goods free of charge.

5. Data

5.1 If you place an order with MY PLANET LED, your data will be included in the customer base of MY PLANET LED. MY PLANET LED adheres to the Data Protection Act and will not provide your information to third parties. See our Privacy Policy.

5.2 MY PLANET LED respects the privacy of the users of the website and ensures confidentiality of your personal information.

5.3 MY PLANET LED sometimes makes use of a mailing list. Each mailing includes instructions to remove yourself from this list.

6. Warranty

6.1 MY PLANET LED ensures that the supplied LED products are provided with CE and Rohs marks

and thus meet the highest quality standards.

6.2 The warranty MY PLANET LED is 2 years for all kinds of LED lamps and fixtures and 1 year for Led transformers. MY PLANET LED is not responsible for defects caused by misuse of our Led articles. The warranty is only valid on technical defects caused by manufacturing defects.

6.3 The warranty on all our LED articles is NOT valid if:

LED lamps that are not dimmable are connected to a dimmer system, even if they are not dimmed.

One installs LED lights in a fully enclosed luminaire (without ventilation / cooling).

LED lights 12-volt are connected incorrect or not to a  LED transformer.

One connects LED lights incorrectly to the power supply or transformer or through any short circuits.

Indoor LED lights are used outdoor.

LED lamps without original packaging and without clear proof of purchase / deposit slip.

6.4 The buyer is obliged to check the delivered articles immediately upon receipt. If it appears that the delivered articles are wrong, faulty or incomplete, the purchaser must (before proceeding to return to MY PLANET LED) report these defects immediately via email or telephone to MY PLANET LED. Any defects or incorrectly delivered articles and can be notified up to 7 days after delivery to MY PLANET LED by email or phone. Return of Goods must be in original packaging (Including any accessories and documentation) and are in mint condition. The right to claim or return lapses for commissioning after detection of defects, damage occurring after detection of failure, encumbrance and / or resale after detection of failure. If complaints of the buyer are founded well founded,  MY PLANET LED will assess whether the delivered articles will be replaced free of charge.

6.5 If, despite everything, a Led product becomes defective  during the 2-year warranty please return the article in its original packaging and with a clear proof of purchase and or send deposit slip (for the shipping costs are always borne by the buyer). Or contact us by email or phone so you can make an appointment when you can personally come to us in order to exchange your faulty product free of charge.

7. Offers

7.1 Offers are not binding unless otherwise stated in the offer.

7.2 Upon acceptance of an offer by the buyer MY PLANET LED retains the right to revoke or deviate the offer within 3 working days after receipt of acceptance.

7.3 Verbal agreements bind MY PLANET LED only after an explicit and written acknowledgment.

7.4 MY PLANET LED offers do not apply automatically to repeat orders.

7.5 MY PLANET LED can not be held responsible for  its offer if the customer should have understood that the offer or any part thereof,  contains an obvious mistake or error.

7.6 Additions, modifications and / or further agreements are effective only if agreed in writing.

8. Agreement

8.1 An agreement between MY PLANET LED and a customer can only exist after an order is assessed feasible by MY PLANET LED.

8.2 MY PLANET LED reserves the right not to accept orders or contracts without reasons or only to accept them  on condition that the shipment takes place on delivery or prepayment.

9. Images and specifications

All images; photos, drawings etc .; among others information on weights, dimensions, colors, graphics, labels, etc. on the webshop MY PLANET LED are only approximate, are indicative and may not lead to damages or rescission of the contract. These may be used either by a third party without the express written consent of MY PLANET LED. In the event that permission is granted, the source must be mentioned.

10. Payments

Customer should do payments to MY PLANET LED in accordance with the ordering process and possibly meet on the webshop specified payment methods. MY PLANET LED is free to choose to offer payment methods and may also modify them from time to time.All our invoices are payable net without discount at our registered office, unless otherwise stated on the invoice itself. At full or partial non-payment on the due date, an interest of 8.5% per annum until full payment with a minimum of loss of 10% shall be added automatically without warning and/or notice , even in granting grace period, without prejudice to our right to prove the actual damages suffered and to claim compensation.

We reserve the right, during the contract of performance, to demand guarantee for payment from  our customers. Lack of timely security gives us the right to suspend all commitments and to cancel without the intervention of the court by registered letter, without demand of compensation of the customer, unchanged and our right to compensation.

At any default, bankruptcy, application for composition or suspension of payments or liquidation, publication of protested bills, summons to court under arrears, opening file to a service to track down companies in difficulty, press releases about poor solvency, or apparent insolvency customer, or sale, transfer, pledge or contribution in a society of the business assets or equipment of the customer or if the customer is not a substitution timely acceptance, all outstanding amounts legally claimable, without notice of default and despite authorized payment arrangements and / or drawing of bills / promissory notes and / or agreed staggered versions of the contract and we reserve the right to suspend all our connections or break the agreement without judicial intervention by registered letter without the customer may request any compensation, without prejudice to our right to compensation. Pulling order or check is only valid as payment on the day we receive the unconditional order or check amount.

The customer will not deduct guarantees on payment of invoices, even in cases of dispute the customer  will not suspend the payment. All protest banking and discount costs are borne by the customer.

Until the time of full payment of the sale price and appurtenances, the goods, services and related or additional documents remain our property. The buyer is not allowed to transfer the goods, services and related or additional documents as long as the purchase price has not been completely liquidated.

 

11. Force majeure

11.1 MY PLANET LED is not liable if and when she can not be fulfilled due to force majeure.

11.2 Force majeure means any strange reason, and any circumstance, which does not belong to occur in all fairness. Delay or failure by our suppliers, disruptions in the Internet, disruptions in the electricity, failures in e-mail traffic and disturbances or changes in any third party technology, transport problems, strikes, government measures, supply delay, negligence by suppliers and / or manufacturers of MY PLANET LED as well as from individuals, disease, defects in appliance or shipment tools count explicitly as force majeure.

11.3 MY PLANET LED reserves the right to suspend the right to its obligations in the event of force majeure and is also entitled to terminate the contract in whole or in part, or to claim that the content of the agreement is amended so as execution remains possible. In no event shall MY PLANET LED be obliged to pay any penalty or damages.

11.4 If MY PLANET LED in the occurence of the event of the force majeure already partially fulfilled its obligations, or can only comply a part of its obligations, MY PLANET LED is entitled to invoice of the already delivered or deliverable part separately and the buyer is obliged to pay this invoice as were it a separate contract. This does not apply if the already delivered or deliverable  part has no independent value.

12. Liability

MY PLANET LED is not liable for damage to vehicles or other property caused by improper use of the products. Before use, read the instructions on the packaging and / or consult our website and / or send us your questions via email.

13. Applicable law / jurisdiction

All agreements are governed by Belgian law.
